What should I do if I am injured by a drunk driver in Florida?
Unfortunately, DUI crashes happen all the time. They don’t just happen in Miami or Broward, but throughout all of Florida and the US. I often get asked, “What do I do? I had this drunk driver hit my car. What are my rights?” For the most part, it is the same. You might have some additional remedies for you under Florida law, where you might not have to pay for the deductible on some of your expenses. You might also be able to go after them for punitive damages.
I had one case in which my client was at a red light and got rear-ended really badly. At first, he didn’t notice that the driver was drunk. Once the police showed up, she started offering them Taco Bell, and it became obvious that she was drunk. He was surprised and didn’t know what to do. I was able to help him through the process.
I had another DUI case in which the drunk driver left the crash scene. Luckily, my client was able to get the license plate of the car, and we were able to hunt her down. She started denying even being there, but we did our investigation, and we were able to find out that she was there. She had even called 9-1-1 from the scene. We were able to find that call, and she couldn’t deny it once we played her the recording of her voice.
