The driver was going way too fast to stop on time, even though they should have yielded to a pedestrian, and hit them. The pedestrian in this case might be deemed 30% at fault for the accident. If they were awarded $100,000 in damages, that would be reduced by 30% to $70,000, which accounts for their role in causing the accident.
